Danielle Louise Foster, 34, of Kearsley Selections Road, has been in custody since May 5 when police saw her car clip a centre island at traffic lights on Melbourne Street, East Maitland about 12.45am.

In Maitland Local Court yesterday, Foster’s solicitor said his client was fleeing a party after a man indecently grabbed her. Last month, he told the court his client did not pull over because she had earphones in and did not hear the police sirens.

On Monday, the court heard Foster had driven through two red lights and was clocking speeds of between 100km/h and 120km/h in an 80km/h zone when police began the chase.

Court documents said police had all warning signals and lights activated as they followed three seconds behind Foster, who at times indicated left and right swerving to the wrong side of the road.

When she saw road spikes on Hunter Street, Foster locked her breaks and attempted to drive around them but collided with a police car. She was pulled from the car and spat at police.

Foster’s solicitor told the magistrate Darryl Pearce his client was upset because of the incident at the party and asked him to consider ordering Foster to rehabilitation.

“I’m not going to go that way, she has a record of drink-driving,” Mr Pearce said.

“I can’t accept submissions that she was unaware police were pursuing her and if she had been assaulted any reasonable person would have told police and had the man

arrested for assault.”

Foster was jailed nine months for not stopping during a pursuit; six months for assaulting a police officer; three months for resisting an

officer; four months for mid-range drink-driving and her driver’s licence disqualified 12 months; and fined $400; and disqualified three months for driving with a suspended licence.

She will be eligible for release on February 4, 2013.
