Save Our Rail and its barrister Shane Prince launched urgent legal action on Friday morning with a duty judge who granted the Tuesday hearing.
By 4pm Friday afternoon the state government had been served the papers.
“We’ve cleared the first hurdle by getting a hearing,” Save Our Rail vice president Kim Cross said.
“Our argument is that we have reasonable apprehension that the government or the Minister for Transport [Gladys Berejiklian] will commence removing the tracks and other rail works from Boxing Day.”
