Police said the off duty cop saw a man acting suspiciously at Woolworths in Pender Place on Tuesday afternoon.
It is alleged that he stole chocolates and other confectionery from the shelves and left the business.
The off-duty officer apprehended the man outside the store. Police searched his bag and found a number of items alleged to have been stolen.
He was charged with stealing and goods in custody and was due to appear before Maitland Local Court on Wednesday.
