Police said the 34-year-old man was intoxicated when he approached the driver on Bourke Street, Maitland requesting a job about 5.30pm on Monday.
It is alleged the man then started taking things out of the driver's ute and became aggressive when the driver questioned him.
Police claim the man then sat in the passenger side of the ute and when the driver approached him, he got out and pushed the driver.
The man then walked into the year of a nearby house and allegedly slammed a gate which caused damage to a fence, police said.
The driver and a passerby then restrained the man due to concerns they had for the elderly resident of the house.
Police were called and arrested the man. He was charged with assault and malicious damage and refused bail to appear in Maitland Local Court on Tuesday.
