"Unanimous decision - jury unable to agree on decision after considering all evidence," the note, which was read in Newcastle District Court at 3.22pm, read.
Judge Peter Whitford, SC, called the jury in and gave them a direction to continue deliberating, saying experience had shown that jurors were able to agree on a verdict if given more time to discuss the issues.
The jury retired to continue deliberating but a few minutes later sent another note that said they would reconvene on Monday.
It is unclear what the split in the jury room is and the jury is believed to have been deliberating for less than eight hours when they broke on Friday afternoon.
Mr Hayne, now 32, has pleaded not guilty to two counts of aggravated sexual intercourse without consent and inflict actual bodily harm and is in the second week of a trial in Newcastle District Court.
