Police were on patrol on Wollombi Road about 3am when a vehicle travelling in the opposite direction appeared to make a quick right turn.
The car allegedly mounted the gutter before it pulled into a service station.
Police ran checks on the car while the driver refueled and found the registration on the vehicle was cancelled.
The owner of the vehicle’s licence was also suspended.
Police allege the man appeared to be intoxicated, which was confirmed by a roadside breath test.
He was taken to Cessnock Police Station where he allegedly recorded .113 in a breath analysis.
Police said he was also found to be in breach of a previous bail condition, which did not permit him to drink alcohol.
The 40-year-old was charged with mid-range drink driving, driving while suspended and driving an unregistered vehicle.
His licence was confiscated and he will appear in court in April.
Driver allegedly blows .133
A man has been charged for driving with nearly three times the legal level of alcohol in his blood.
Police allegedly spotted a vehicle mount a kerb in Rutherford East Mall about 10.10pm on Friday night.
Police approached the 28-year-old and gave him a roadside breath test, which returned a positive result.
He was arrested and given a breath analysis, where he allegedly blew .133.
His licence was suspended. He will appear in Maitland Local Court next month.
